    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and Baesrix Tech (OPC) Private Limited("Company", "we", "us", or "our") governing your access to and use of Apparella and related services.

    By accessing or using our service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the service.

    2. Description of Service

    Apparella is an AI-powered platform that enables users to:

    • Create structured prompts for AI image generation
    • Configure fashion and outfit attributes
    • Generate natural language prompts using AI
    • Generate images using integrated AI models
    • Upload images for virtual try-on and outfit visualization
    • Save, share, and collaborate on projects

    3. Account Registration

    To use certain features, you must create an account. You agree to:

    • Provide accurate and complete registration information
    • Maintain the security of your account credentials
    • Promptly update any changes to your information
    • Accept responsibility for all activities under your account
    • Notify us immediately of any unauthorized access

    You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental or guardian consent to use the service.

    4. Acceptable Use

    You agree NOT to use the service to:

    • Generate illegal, harmful, or offensive content
    • Create non-consensual intimate imagery of real people
    • Infringe on intellectual property rights of others
    • Harass, abuse, or harm other users
    • Impersonate individuals or entities
    • Distribute malware or engage in hacking
    • Circumvent usage limits or access controls
    • Use automated tools to scrape or extract data
    • Resell or redistribute the service without authorization
    • Generate content depicting minors in inappropriate contexts
    • Create deepfakes or misleading media intended to deceive

    We reserve the right to suspend or terminate accounts that violate these guidelines.

    5. User Content

    5.1 Your Content

    You retain ownership of content you create or upload ("User Content"). By using the service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the service.

    5.2 Uploaded Images

    When uploading images, you represent and warrant that:

    • You own the images or have rights to use them
    • You have consent from any individuals depicted
    • The images do not violate any laws or third-party rights

    5.3 Generated Content

    Subject to these Terms and applicable laws, you may use AI-generated outputs from the service for personal or commercial purposes. However, we make no guarantees regarding the uniqueness or intellectual property status of generated content.

    6. Credits and Payments

    6.1 Credit System

    The service operates on a credit-based system. Credits are required for certain actions including prompt generation and image generation. Credit costs for each action are displayed before use.

    6.2 Purchases

    All purchases are final unless otherwise stated. We reserve the right to modify pricing with reasonable notice.

    6.3 Subscriptions

    Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings. Upon cancellation, you retain access until the end of the current billing period.

    6.4 Refund Policy

    Credits are generally non-refundable once purchased. However, we may issue refunds in the following circumstances:

    • Technical failures on our end that prevented credit usage
    • Duplicate or erroneous charges
    • Service unavailability for extended periods
    • As required by applicable consumer protection laws

    Refund Request Process: To request a refund, contact us at contact@apparella.ai within 14 days of the transaction. Include your account email, transaction details, and reason for the request. We will review and respond within 7 business days.

    Subscription Refunds: If you cancel a subscription, you will not receive a refund for the current billing period but will retain access until it ends. Refunds for subscription charges are only available within 48 hours of the charge if no credits from that period have been used.

    Refund Method: Approved refunds will be credited to the original payment method within 5-10 business days, depending on your payment provider.

    7. Intellectual Property

    7.1 Our Property

    The service, including its design, features, code, and content (excluding User Content), is owned byBaesrix Tech (OPC) Private Limited and protected by intellectual property laws. You may not copy, modify, or distribute any part of the service without our written permission.

    7.2 Trademarks

    Apparella, our logo, and related marks are trademarks of Baesrix Tech (OPC) Private Limited. You may not use these marks without our prior written consent.

    8. Third-Party Services

    Our service integrates with third-party AI providers (such as OpenAI, Google) for content generation. Your use of these features is also subject to the respective third-party terms. We are not responsible for third-party services and their outputs.

    9. Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

    • Merchantability or fitness for a particular purpose
    • Accuracy, reliability, or completeness of AI-generated content
    • Uninterrupted or error-free operation
    • Security or freedom from viruses

    10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAESRIX TECH (OPC) PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

    11. Indemnification

    You agree to indemnify and hold harmless Baesrix Tech (OPC) Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

    12. Termination

    We may suspend or terminate your access to the service at any time, with or without cause or notice. Upon termination:

    • Your right to use the service immediately ceases
    • We may delete your account and associated data
    • Provisions that should survive termination will remain in effect

    You may delete your account at any time through your account settings.

    13. Changes to Terms

    We may modify these Terms at any time. We will provide notice of material changes via email or through the service. Your continued use after changes take effect constitutes acceptance of the new Terms.

    14. Governing Law

    These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. If any provision is found unenforceable, the remaining provisions will continue in effect.
